PRESIDENTE CONSTITUCIONAL DE LA REPUBLICA

Considerando:

Que el Presidente de la República Mariscal Andrés Santa Cruz y Calahumana instituyó el 17 de noviembre de 1835 la Condecoración "Legión de Honor Boliviana", para reconocer y premiar los méritos de ciudadanos que hubieran contribuido con el engrandecimiento de la República.

Que el Gobierno Nacional estableció nuevamente la ṿigencia de la Condecoración "Legión de Honor Boliviana", mediante Decreto Supremo 22243 de 11 de julio de 1989, con la finalidad de distinguir y recompensar a los ciudadanos bolivianos que hayan prestado servicios eminentes a la República.

Que la otorgación de la Condecoración "Legión de Honor Boliviana", fue exclusivamente para ciudadanos bolivianos, por lo que, se hace necesario extender esta condecoración también para ciudadanos ex̣tranjeros e instituciones.

EN CONSEJO DE GABINETE, DECRETA:

Artículo Único.-

I. Se aprueba el Reglamento de la Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana", como parte integral del presente Decretọ Supremo.

II. Se modifica el inciso b) del Artículo 56 del Reglamento del Ceremonial Diplomático, aprobado mediante Decreto Supremo 22243 de 11 de julio de 1989, designando a la Legión de Honor Boliviana como Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana" y, extendiendo su otorgacion a ciudadanos extranjeros e instituciones nacionales y extranjeras que hayan prestado servicios eminentes a la República, en los que se destaquen los altos valores cívicos en los que se funda la República.

III. El Ministro de Relacịones Exteriores y Culto es el responsable de la implementación del Reglamento de la Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana".

REGLAMENTO DE LA ḶEGION DE HONOR

"MARISCAL ANDRES SANTA CRUZ Y CALAHUMANA"

Artículo 1.- La Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana" instituida por Decreto Supremo 22243 de 11 de julio de 1989 tiene por objeto distinguir y recompensar a los ciudadanos que hayan prestado servicios eminentes a la República.

Artículo 2.- Resulta pertinente ampliar la otorgación de dicha condecoración a extranjeros e instituciones que hayan prestado eminentes servicios a la Nación.

Artículo 3.- Las condecoraciones de la Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana" por orden de jerarquía y prelación son las siguientes:

a) Gran Collar

b) Gran Cruz

c) Gran Oficial

d) Comendador

e) Oficial

f) Caballero

Artículo 4.- La dignidad y el Título de Gran Maestre de la Legión de Honor corresponde al Presidente de la República en el Grado de Gran Collar, el Ministro de Relaciones Exteriores y Culto ejercerá el cargo de Canciller de la Legión en el Grado de Gran Cruz, y el Director General de Ceremonial del Estado, ejercerá la Secretaria de la Legión, en el Grado de Gran Oficial.

Artículo 5.- Es atribución del Presidente de la República conferir la Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana" mediante Resolución Suprema.

Artículo 6.- Las solicitudes para la otorgación de la Legión de Honor, serán dirigidas por escrito al Ministro de Relaciones Exteriores y Culto, que dispondrá la elaboración de un expediente que haga constar todos los antecedentes del candidato o de la institución en su caso, detallando los méritos y servicios prestados a la Nación, el mismo que será elevado a consideración del Excmo. Señor Presidente de la República.

Artículo 7.- El Presidente de la República concederá la Legión de Honor a los bolivianos, extranjeros e instituciones que se hubiesen hecho acreedores a esta distinción aún después de fallecidos, en testimonio de gratitud nacional por sus méritos y servicios eminentes prestados al país.

Artículo 8.- La Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana", se concederá a perpetuidad.

Artículo 9.- El "Gran Collar" será de color dorado, tiene diez estrellas entrelazadas por kantutas de color rojo, amarillo y verde, y a su vez, están intercaladas por estrellas de ocho puntas con una insignia de RB, que significa República de Bolivia. Al medio del Gran Collar cuelga un emblema de 6 centímetros de diámetro de plata sobredorada que llevará en el centro un óvalo de color azul con la efigie del Mariscal Andrés Santa Cruz y Calahumana donde se encontrará grabado en letras doradas "Legión de Honor Mariscal Andrés Santa Cruz y Calahumana" rodeado de 6 rayos en primera línea y 12 rayos en segunda línea. El botoniẹr será de color dorado con cintillo azul.

Artículo 10.- La Condecoración en el grado de "Gran Cruz", estará compuesta por un emblema de 6 centímetros de diámetro de plata sobredorada que llevará en el centro la efigie del Mariscal Andrés Santa Cruz y Calahumana en su entorno estará rodeada de un óvalo de color azul donde estará grabado Legión de Honor Mariscal Andrés Santa Cruz y Calahumana rodeado de cinco aspas de color dorado con sobrecubierta de esmalte blanco. Dichas aspas estarán unidas por kantutas.

La banda de la condecoración será de color azul de 10 centímetros de ancho y terminará en un rozón que llevará colgando la joya de caballero. El botonier será de color azul con el centro dorado y cintilla de ambos lados dorados.

Artículo 11.- La Condecoración en el grado de "Gran Oficial", estará compuesta por un emblema de 6 centímetros de diámetro de plata sobredorada que llevará en el centro la efigie del Mariscal Andrés Santa Cruz y Calahumana, en su entorno estará rodeado de un óvalo de color azul, donde estará grabado Legión de Honor Mariscal Andrés Santa Cruz y Calahumana, rodeado de cinco aspas de color dorado con sobrecubierto de esmalte blanco. Con botonier azul, el centro dorado y el cintillo izquierdo de color dorado y el derecho de color plateado.

Artículo 12.- La condecoración en el grado de "Comendador" estará compuesta por un emblema de 5.5 centímetros de diámetro de plata sobredorada que llevará en el centro la efigie del Mariscal Andrés Santa Cruz y Calahumana, en su entorno estará rodeado de un óvalo de color azul donde estará grabado Legión de Honor Mariscal Andrés Santa Cruz y Calahumana con cuatro aspas doradas con esmalte blanco. Las aspas estarán unidas por kantutas. La joya estará rematada por una corona de laureles y un gancho donde pasará una cinta de color azul de 3 centímetros de ancho para colgar la joya al cuello. El Botonier será de color azul con centro dorado y cintillo de color plateado en ambos lados.

Artículo 13.- La condecoración en el grado de "Oficial" estará compuesto por un emblema de 5 centímetros de diámetro de plata sobredorada que llevará en el centro la efigie del Mariscal Andrés Santa Cruz y Calahumana, en su entorno estará rodeado de un óvalo de color azul donde estará grabado Legión de Honor Mariscal Andrés Santa Cruz y Calahumana, rodeado de cuatro aspas de color dorado con sobrecubierta de esmalte blanco, dichas aspas estarán unidas por kantutas, con una cinta de color azul en cuya superficie se encontrará un rozón o moño con cinta del mismo color. Este será colgado en la solapa izquierda del condecorado. El Botonier será azul con dorado.

Artículo 14.- La condecoración en el grado de "Caballero" estará compuesta por un emblema de 4 centímetros de diámetro de plata sobredorada que llevará en el centro la efigie del Mariscal Andrés Santa Cruz y Calahumana, en su entorno estará rodeado de un ovalo de color azul índigo donde estará grabado Legión de Honor Mariscal Andrés Santa Cruz y Calahumana, con cuatro aspas doradas con esmalte blanco, las aspas estarán unidas por kantutas. La mencionada condecoración penderá de una cinta azul para ser colgada en la solapa izquierda del Condecorado. El botonier será un ganchito de color azul.

Artículo 15.- Se perderá el derecho a uso y a la propiedad de la Legión de Honor "Mariscal Andrés Santa Cruz y Calahumana" por las causales señaladas en el Artículo 42 de la Constitución Política del Estado, por traición a la Patria y por irregularidades comprobadas en el expediente de antecedentes del condecorado. El Ministro de Relaciones Exteriores y Culto, emitirá una Resolución certificando la perdida del derecho al uso de la Legión. En su caso la joya y el diploma deberán ser devueltos por su beneficiario.

Artículo 16.- El Director General de Ceremonial del Estado, será el depositario y guardián de las insignias y diplomas de la Orden y llevará el registro oficial en el Gran Libro de la Legión, detallando las condecoraciones otorgadas.

Considering:

IN CABINET ADVICE, IT DECREES:

Unique article. -I. is approved the Regulation of the Legion of Honor “Marshal Andres Santa Cruz and Calahumana”, like integral part of the present Supreme Decree.

II. Interjection b) of Article 56 of the Regulation of the Diplomatic Ceremọnial, approved modifies by means of Supreme Decree 22243 of 11 of 1989 July, designating to the Legion of Bolịviana Honor like Legion of Honor “Marshal Andres Santa Cruz and Calahumana” and, extending its permission to foreign citizens and national and foreign institutions that have served eminent to the Republic, in that stand out the high civic values on which the Republic is based.

III. Minister of Outer Relations and Cult is the person in charge of the implementation of the Regulation of the Legion of Honor “Marshal Andres Santa Cruz and Calahumana”.

REGULATION OF THE HONOR LEGION

“MARSHAL ANDRES SANTA CRUZ AND CALAHUMANA”

Article 1. - The Legion of Honor “Marshal Andres Santa Cruz and Calahumana” instituted by Supreme Decree 22243 of 11 of 1989 July intends to distinguish and to compensate the citizens who have served eminent to the Republic.

Article 2. - It turns out pertinent to extend the permission of this decoration to foreigners and institutions that have served eminent to the Nation.

Article 3. - The decorations of the Legion of Honor “Marshal Andres Santa Cruz and Calahumana” by hierarchy order and preference are the following:

a) Great Necklace

b) Great Cross

c) Great Official

d) Commander

e) Official

f) Horseman

Article 4. - The dignity and the Title of Great Master of the Legion of Honor correspond to the President of the Republic in the Degree of Great Necklace, Minister of Outer Relations and Cult will exert the position of Chancellor of the Legion in the Degree of Great Cross, and the Chief of a main directorate of Ceremonial of the State, will exert the Secretary of the Legion, in the Degree of Great Official.

Article 5. - Marshal Andres Is attribution of the President of the Republic to confer the Legion of Honor “Santa Cruz and Calahumana” by means of Supreme Resolution.

Article 6. - The requests for the permission of the Legion of Honor, will be directed in writing to the Minister of Outer Relations and Cult, who will have the elaboration a ex̣pediente that points out all the antecedents of the candidate or the institution if so, detailing to the merits and served to the Nation, the same that will be elevated to consideration of the Exc. Sir President of the Republic.

Article 7. - The President of the Republic will grant the Legion of Honor to the Bolivians, foreigners and institutions that had become deserving to this distinction still after deceaseds, in testimony of national gratitude by their served merits and eminent to the country.

Article 8. - The Legion of Honor “Marshal Andres Santa Cruz and Calahumana”, will grant itself to perpetuity.

Article 9. - The “great Necklace” will be of golden color, has ten stars interlaced by kantutas of red, yellow and green color, and as well, are put in by stars of eight ends with a RB standard, that means Republic of Bolivia. To means of the Great Necklace it hangs an emblem of 6 centimeters of diameter of silver sobresea bream that will in center take to an oval of blue color with the efigie of Marshal Andres Santa Cruz and Calahumana where will be engraving in letters sea breams “Legion of Honor Marshal Andres Santa Cruz and Calahumana” surrounded by 6 rays in forward edge and 12 rays in second line. Botonier will be of color golden with cintillo blue.

Article 10. - The Decoration in the degree of “Great Cross”, will be composed by an emblem of 6 centimeters of diameter of silver sobresea bream that will in center take to the efigie of Marshal Andres Santa Cruz and Calahumana in its surroundings will be surrounded by an oval of blue color where Legion of Honor will be recorded Marshal Andres Santa Cruz and Calahumana surrounded by five vanes of color golden with white enamel cover. These vanes will be united by kantutas.

Article 15. - The right to use and the property of the Legion of Honor will be lost “Marshal Andres Santa indicated Cruz and Calahumana” by the causal ones in Article 42 of the Political Constitution of the State, by treason to the Mother country and irregularities verified in the file of antecedents of the decorated one. Minister of Outer Relations and Cult, will emit a Resolution cẹrtificando the lost one of the right to the use of the Legion. If so the jewel and the diploma will have to be given back by their beneficiary.

Article 16. - The Chief of a main directorate of Ceremonial of the State, will be the deposit taker and guardian of the standards and diplomas of the Order and will take to the official registry in the Great Book of the Legion, detailing the granted decorations.
