D E C R E T E CHAPITRE I : DISPOSITIONS GENERALES Article 1 : Il est créé une distinction honorifique dénommée Ordre du Mérite de la Santé et de l’Action Sociale Article 2 : L’Ordre du Mérite de la Santé et de l’Action Sociale est destiné à récompenser tout agent des Ministères chargés de la Santé et de l’Action Sociale qui se serait particulièrement distingué par son dévouement, son engagement professionnel, ses compétences et par sa contribution à l’accroissement du rendement desdits Ministères. Il peut être aussi décerné à toute personne physique ou morale qui a rendu des services importants aux secteurs de la Santé et de l’Action Sociale. Article 3 : L’administration de l’Ordre du Mérite de la Santé et de l’Action Sociale est assurée par la Grande Chancellerie des Ordres Burkinabé sous la haute autorité du Président du Faso. Article 4 : L’Ordre du Mérite de la Santé et de l’Action Sociale comprend les grades suivants : - Chevalier - Officier - Commandeur. En outre, il comporte deux (02) agrafes suivants : - Santé - Action Sociale CHAPITRE II : DESCRIPTION Article 5 : L’insigne de l’Ordre du Mérite de la Santé et de l’Action Sociale est constitué d’une médaille de 36 mm de diamètre suspendue à un ruban de 37 mm de large. Elle présente : A l’avers et en relief : * Un caducée symbolisant les professions de santé ; * Le logo du Ministère de l’Action Sociale qui représente la protection de l’enfance, la promotion de la famille et de la solidarité . Au revers, en relief, les inscriptions : «BURKINA FASO », la devise :« UNITE-PROGRES-JUSTICE » et « ORDRE DU MERITE DE LA SANTE ET DE L’ACTION SOCIALE» Article 6 : L’insigne du Chevalier est une médaille de 36 mm de diamètre, en bronze patiné suspendu à un ruban de 37 mm de large. Le ruban est constitué de deux bandes verticales de largeurs égales alternées (vert, rouge). L’insigne d’Officier est une médaille de 36 mm de diamètre, en bronze argenté, suspendu à un ruban identique à celui de Chevalier portant une rosette. L’insigne de Commandeur est une médaille de 36 mm de diamètre en bronze doré suspendu à un ruban cravate de même couleur que celui de Chevalier et d’Officier. Article 7 : Les insignes de boutonnières qui peuvent être portés sans décorations sont constitués par : - Un ruban de 3 mm de largeur pour le Chevalier ; - Une rosette de 8 mm de largeur pour l’Officier ; - Une rosette de 8 mm de largeur sur galon argenté pour le Commandeur. CHAPITRE III : CONDITIONS D’ADMISSION ET D’AVANCEMENT Article 8 : L’Ordre du Mérite de la Santé et de l’Action Sociale est attribué par décret du Président du Faso, sur proposition des Ministres chargés de la Santé et de l’Action Sociale à l’un des titres suivants : Normal, Exceptionnel et Posthume. Article 9 : Seuls concourent à l’admission à titre normal, les candidats des deux sexes de nationalité Burkinabè, remplissant les conditions suivantes : . avoir vingt cinq (25) ans minimum .avoir dix (10) ans de service effectifs pour les fonctionnaires; . jouir de ses droits civiques. Article 10 : Sont proposés à titre exceptionnel : les nationaux ne remplissant pas les conditions de durée de service ou d’ancienneté de grade pour être proposés à titre normal, mais dont les services extraordinaires rendus au pays justifient une proposition à titre exceptionnel ; les étrangers, qu’ils soient domiciliés ou non au Burkina Faso et dont la contribution au développement du pays a été jugée remarquable. Article 11 : Sont proposés à titre posthume les nationaux et les étrangers décédés à la suite d’un acte de courage ou de dévouement dans l’exercice de leurs fonctions ou après une carrière particulièrement méritante dans les conditions prévues à l’article 2 et qui n’ont pas été de leur vivant, membres de l’Ordre. La proposition doit être faite dans un délai de six (06) mois après le décès de la personne proposée. Article 12 : Une ancienneté minimale de cinq (05) ans au grade immédiatement Inférieur est exigée pour être promu au grade d’Officier ou de Commandeur. Toutefois, il peut être dérogé aux conditions d’ancienneté prévues à l’alinéa précédent si le candidat justifie de services exceptionnels rendus à l’Etat burkinabè. Article 13 : Les nominations et promotions ont lieu, sauf circonstance exceptionnelle, chaque année à l’occasion de la célébration de la fête nationale de l’indépendance ou à une date fixée par le Grand Chancelier sur proposition des Ministres chargés de la Santé et de l’Action Sociale. Article 14 : Nonobstant les dispositions des articles 9 et 12, sont dispensés des conditions de temps de service et d’ancienneté les étrangers non domiciliés au Burkina Faso, les membres des missions diplomatiques accrédités au Burkina Faso, les organisations ou associations internationales ou de la coopération technique. CHAPITRE IV : PROCEDURE ET COMPOSITION DU DOSSIER Article 15 : Sur proposition du conseil de l’Ordre, un décret détermine les contingents de décorations à attribuer chaque année aux différents grades, ainsi que leur répartition entre les différents départements ministériels concernés. Article 16 : Dans le trimestre qui précède la date mentionnée à l’article 13 ci-dessus, les Ministères concernés adressent à la Grande Chancellerie les dossiers de proposition des candidats relevant de leur autorité pour être soumis à l’examen du Conseil de l’Ordre. Article 17 : De l’ensemble des propositions retenues en Conseil de l’Ordre, le Grand Chancelier forme un corps de décret qu’il soumet à l’approbation du Président du Faso. Article 18 : Le dossier de proposition comprend : a) Personne physique : . un mémoire de proposition ; . un acte de naissance ; . un casier judiciaire n°2 pour les non fonctionnaires (à demander par l’administration) ; . un certificat de décès pour la proposition à titre posthume. b) Personne Morale (Sociétés, Associations ou ONG) : . un mémoire de proposition ; . un acte de reconnaissance juridique datant d’au moins cinq (05) ans. Les dossiers de proposition en faveur des étrangers et des membres du corps diplomatique sont établis et transmis par le canal du Ministère chargé des Affaires Etrangères au Grand Chancelier. CHAPITRE V : LE CONSEIL DE L’ORDRE Article 19 : Le Conseil de l’Ordre du Mérite de la Santé et de l’Action Sociale comprend : Président : Le Grand Chancelier des Ordres Burkinabè. Membres : Les membres du Conseil de l’Ordre du Mérite Burkinabè ; Un (01) représentant de chaque Ministère. Rapporteur : Le Secrétaire Général de la Grande Chancellerie, assisté du Chancelier Article 20 : Les membres du Conseil de l’Ordre sont nommés par Décret. Article 21: Le Conseil donne son avis sur les nominations et promotions dans l’Ordre du Mérite de la Santé et de l’Action Sociale. Il est consulté sur toute décision concernant l’Ordre, notamment sur les mesures de suspension ou de radiation. CHAPITRE VI : CEREMONIAL DE RECEPTION DANS L’ORDRE Article 22 : Les récipiendaires peuvent recevoir leurs médailles des mains du Président du Faso, du Grand Chancelier, des Ministres,ou des Gouverneurs même s’ils ne sont pas membres de l’Ordre. Article 23 : Peuvent recevoir délégation de pouvoir du Grand Chancelier pour procéder à une réception dans l’Ordre, les membres de l’Ordre titulaires d’un grade au moins égal à celui du récipiendaire. A égalité de grade entre les membres des Ordres, le délégué doit être le plus ancien. Article 24 :Tout membre de l’Ordre National ou de l’Ordre du Mérite Burkinabè, de quelque rang qu’il soit, peut recevoir délégation du Grand Chancelier pour procéder à la réception dans l’ordre de Mérite de la Santé et de l’Action Sociale. Article 25 :Nonobstant les articles 22 et 23, les Ambassadeurs représentant le Président du Faso, reçoivent délégation pour l’admission des étrangers dans l’Ordre du Mérite de la Santé et de l’Action Sociale. Article 26 :Un diplôme signé du Grand Chancelier est délivré à chaque membre de l’ordre. Article 27 : Nul ne peut se prévaloir de la qualité de membre de l’Ordre et porter les insignes avant d’avoir été admis et reçu. Article 28 : Un décret du Président du Faso fixera selon le cas, les conditions de perception des droits de Chancellerie et les cas d’exemption. CHAPITRE VII : PORT DES INSIGNES Article 29 :Les citoyens Burkinabè ne peuvent porter les insignes du grade auquel ils ont été nommés ou promus qu’après les cérémonies de réception. Les décorations Burkinabè sont portées avant toute autre distinction honorifique étrangère. Article 30 : Un décret du Président du Faso déterminera l’Ordre de port des décorations nationales. Article 31 : Un membre de l’Ordre du mérite ne peut porter à la fois les insignes de l’ancien grade et ceux du nouveau. Les décorations pendantes ne se portent en général qu’à l’occasion des cérémonies officielles. CHAPITRE VIII :DISCIPLINE Article 32 : Les sanctions disciplinaires qui peuvent être prises contre les membres de l’Ordre sont : . La suspension provisoire ; . L’exclusion. Article 33 : La suspension provisoire peut être prononcée à l’encontre : . d’un membre de l’Ordre faisant l’objet de poursuites pénales pour faits qualifiés de crimes ou délits intentionnels. ; . d’un membre de l’ordre condamné à une peine correctionnelle n’excédant pas trois (03) mois d’emprisonnement ; . d’un membre de l’Ordre s’adonnant habituellement à des pratiques attentatoires à l’honneur et à la dignité. Article 34 : L’exclusion est prononcée à l’encontre : . d’un membre de l’Ordre condamné à des peines afflictives et infamantes ou supérieures à trois (03) mois d’emprisonnement ferme ou avec sursis ; . de tout membre ayant été déchu des droits civiques. Article 35 : Le bénéfice d’une mesure d ‘amnistie ne peut entraîner la réhabilitation d’un membre de l’Ordre si ce n’est par le biais d’une nouvelle proposition. Article 36 : Les sanctions disciplinaires contre les membres de l’Ordre sont prononcées par décret du Président du Faso après avis du Conseil de l’Ordre. Article 37 : Toute procédure disciplinaire ou pénale engagée contre un membre de l’Ordre est portée sans délai à la connaissance du Grand Chancelier par les soins de l’autorité qui en a pris l’initiative. Article 38 : Le port illégal de l’insigne de l’Ordre et l’usurpation de la qualité de membre de l’Ordre sont punis conformément à la loi. Article 39 : Il est interdit à tout membre de l’Ordre de se prévaloir de sa qualité dans un but publicitaire. Eligible Service The AOSM – Special Operations recognises the service of Australian Defence Force members on special operations as declared by the Chief of the Defence Force from 1 November 2019. Medal The medal is a cupro-nickel medal finished in antique silver. The obverse bears an old-world stylised world globe signifying global operations, interlinked with a Federation Star.
